Statement of Facts and Findings <br />effects from cumulative land uses would not occur. Cumulative impacts related to land use and <br />planning would be less than significant. <br />B. Findings <br />The City finds that: <br />The Heritage Mixed Use project would not result in a significant impact involving conflict with any <br />applicable policy or regulation adopted for the purpose of avoiding or mitigating an environmental <br />effect. Thus, these land use and planning related impacts would be less than significant, and no <br />mitigation measures are necessary. <br />Noise <br />A. Facts <br />1. The project would not result in exposure of persons to, or generation of, noise levels in excess of <br />standards established in the City's General Plan or noise ordinance. Construction related noise <br />levels would fluctuate depending on the particular type, number, and duration of uses of various <br />pieces of construction equipment. Project constriction would require the use of heavy <br />construction equipment and small power tools, generators, slid other sources of noise, Noise <br />levels at sensitive receptors during construction would vary based on the amount of equipment in <br />operation and the location of the activity. The City's Municipal Code exempts construction noise <br />from the City's established noise standards as long as they do not take place between the hours of <br />8:00 pen and 7:00 am on weekdays, including Saturday, or any time on Sunday or a federal <br />holiday. As the project's construction activities would only occur during the allowable <br />constntction hours, the project would be in compliance with the City's applicable standards and <br />impacts would be less than significant. <br />2. The project includes development and use of exterior parking facilities, which would generate <br />noise from engines accelerating, doors slamming, car alarms, and people talking. Noise from tine <br />parking facilities would fluctuate throughout the day, with the highest in the peak morning and <br />evening hours when the largest volume of people would enter and exit the parking facilities. The <br />parking noise is typical of residential uses and would not exceed the City's noise standards, and <br />noise impacts would be less than significant. <br />3. The project would provide open space and recreational facilities onsite. The operational noise <br />levels associated with the project's outdoor gathering areas would not cause a substantial increase <br />in the existing exterior noise levels and would not exceed the City's noise standards. Therefore, <br />the operational noise generated by the proj ect at outdoor gathering areas would be less than <br />significant. <br />d.
