Statement of Facts and Flndings <br />Mitigation Measure AQ -12: The City of Santa Ana Planning and Building Agency shall require by <br />contract specifications that landscape contracts for the project site shall include a mandatory <br />minimum of 10 percent of all landscape equipment used onsite be electrically operated. <br />Mitigation Measure AQ -13: The City of Santa Ana Planning and Building Agency shall require by <br />contract specifications that the lease agreements for all multi - family residential and non - residential <br />units: <br />Require provision of information about OCTA and Metrolink transit services in the vicinity <br />of the project site to all residents and employees. <br />Require that transit routes be posted in common areas of multi - family residential buildings <br />and employee /patron areas for non - residential buildings. <br />Land Use and Planning <br />A. Facts <br />The project is subject to the Airport Environs Land Use Plan (AELUP) for .TWA, which includes <br />policies that were adopted for the purpose of avoiding or mitigating an environmental effect. The <br />project would be consistent with airport land use plan policies with implementation of Mitigation <br />Measures LU -1 and LU -2, which requires resident notification and outdoor signage in open space and <br />recreation areas describing the potential annoyances from airport operations. With implementation of <br />Mitigation Measures LU -1 and LU -2, which are AELUP policies, the project would not conflict with <br />the 7WA AELUP. <br />B. Findings <br />The City finds that: <br />The mitigation measures listed below has been required for, and incorporated into the project, to ensure <br />that the project's potential impacts related to land use and planning remain less than significant. <br />Mitigation Measures <br />Mitigation Measure LU -1: The Development Agreement that is required for implementation of the <br />proposed project shall include a clause requiring that all prospective residents of the proj ect site shall <br />be notified of airport related noise, Notification shall be included in lease /rental agreements and shall <br />state the following: <br />"Notice of Airport in Vicinity. This property is presently located in the vicinity of <br />an airport, within what is known as an airport influence area. For that reason, the <br />property may be subject to some of the amnoyances or inconveniences associated <br />with proximity to airport operations related to noise. Individual sensitivities to <br />those annoyances can vary from person to person.
