LS 2.3.16 RESOLUTION NO. 2016 -014 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SANTA ANA AUTHORIZING CITY EXECUTIVE DIRECTORS TO SIGN COUNTY OF ORANGE SIXTY -DAY WAIVER NOTICES REQUIRED BY GOVERNMENT CODE SECTION 25351 BE IT RESOLVED BY THE CITY COUNCIL OF THE CITY OF SANTA ANA AS FOLLOWS: Section 1. The City Council of the City of Santa Ana hereby finds, determines and declares as follows: A. Government Code section 25351 requires that the County of Orange to provide notice to cities when considering certain actions within the respective city's boundaries. B. Specifically, the County Board is required to notify the City Clerk in writing at least sixty (60) days prior to going to out to bid to construct a county building, expand an existing building or the use thereof, or enter into a lease of an existing building within the city where the building is to be constructed, expanded or leased. C. Pursuant to Government Code section 25351(d) the 60 -day notification requirement may be waived if the city council consents by resolution. D. The proposed resolution will allow a City Executive Director to sign the waiver authorizing the County of Orange to proceed with the proposed bid or project prior to the closure of the 60 days provided that City staff has reviewed the County notice for the proposed project or lease of a building, and has determined that it is in conformity with the City of Santa Ana's General Plan. Section 2. The City Council hereby authorizes Executive Directors to sign and approve the waiver of the sixty -day notification requirements imposed upon the County by Government Code section 25351. Section 3. This resolution shall take effect immediately upon its adoption by the City Council and the Clerk of the Council shall attest to and certify the vote adopting this Resolution.
