AGREEMENT NO. C- 5-3832 <br />EXHIBIT D <br />4. "Monthly DBE Trucking Verification" Form <br />Prior to the 10th of each month, the Consultant must submit documentation on <br />the "Monthly DBE Trucking Verification" Form to the Authority showing the <br />amount paid to DBE trucking companies. The Consultant must also obtain and <br />submit documentation to the Authority showing the amount paid by DBE <br />trucking companies to all firms, including owner - operators, for the leasing of <br />trucks. If the DBE leases trucks from a non -DBE, the Contactor may count <br />only the fee or commission the DBE receives as a result of the lease <br />arrangement. <br />The Consultant must also obtain and submit documentation to the Authority <br />showing the truck number, owner's name, California Highway Patrol CA <br />number, and if applicable, the DBE certification number of the owner of the <br />truck for all trucks used during that month. <br />5. "Final Report - Utilization of Disadvantaged Business Enterprises (DBE), <br />First Tier Subconsuitants" <br />Upon completion of the contract, a summary of these records must be <br />prepared on the: "Final Report - Utilization of Disadvantaged Business <br />Enterprises (DBE), First Tier Subconsultants" and certified correct by the <br />Consultant or the Consultant's authorized representative, and must be <br />furnished to the Engineer. The form must be furnished to the Authority within <br />90 days from the date of contract acceptance. The amount of $10,000 will be <br />withheld from payment until a satisfactory form is submitted. <br />8. "Disadvantaged Business Enterprises (DBE) Certification Status <br />Change" <br />If a DBE Sub is decertified during the life of the project, the decertified <br />Subconsultant must notify the Consultant in writing with the date of <br />decertification. If a Subconsultant becomes a certified DBE during the life of <br />the project, the Subconsultant must notify the Consultant in writing with the <br />date of certification (Attach DBE certification /Decertification letter). The <br />Consultant must furnish the written documentation to the AUTHORITY. <br />Upon completion of the contract, the "Disadvantaged Business Enterprises <br />(DBE) Certification Status Change" must be signed and certified correct by the <br />Consultant indicating the DBEs' existing certification status. if there are no <br />changes, please indicate "No Changes ". The certified form must be furnished <br />to the Authority within 90 days from the date of contract acceptance. <br />V. DBE Eligibility and Commercially Useful Function Standards <br />A DBE must be certified at the time of Proposal submission: <br />1. A certified DBE must be a small business concern as defined pursuant to Section 3 of the <br />U.S. Small Business Act and relevant regulations promulgated pursuant thereto. <br />Orange County Transportation Authority <br />Revised. 0510&12014 <br />
