MINUTES OF THE REGULAR MEETING OF THE <br />CODE OF CONDUCT AND ETHICS <br />COUNCIL COMMITTEE <br />NOVEMBER 20, 2013 <br />Meeting Convened at City Hall, 2nd Floor, 20 Civic Center Plaza Santa Ana, CA at 6:16 p.m. <br />In attendance were Committee Members Sal Tinajero and Angelica Amezcua, Chair and <br />Staff members Sonia Carvalho, City Attorney and Maria D. Huizar, Clerk of the Council. <br />PUBLIC COMMENTS — None <br />AGENDA ITEMS <br />1. SELECTION OF CHAIR <br />Motion by Tinajero, seconded by Amezcua to elect Amezcua as Chair. Motion <br />carried. <br />2. APPROVE MINUTES OF THE MARCH 21, 2012 AND JUNE 7, 2012 MEETINGS <br />Motion by Tinajero, seconded by Amezcua to approve Minutes. Motion carried. <br />3-. DISCUSS COMMITTEE BY -LAWS <br />City Attorney Carvalho provided background on rules and procedures. Chair Amezcua <br />motion, seconded by Committee Member Tinajero to hold two meetings a year in May and <br />November and call Special meetings, as needed. Motion carried. <br />4. ANNUAL REVIEW OF CODE OF CONDUCT <br />Deferred discussion to future meeting. <br />5. DISCUSS CITY COUNCIL POLICY AS IT RELATES TO BROWN ACT VIOLATIONS AND <br />SANCTIONS <br />City Attorney Carvalho indicated that cities with Code of Conduct and Ethics have various <br />methods of handling sanctions, such as consideration of resolution, policy referring to <br />enforcement agency, policy can allow for discretion and report to council committee not to <br />create adversarial situation. Will prepare sample policies for review and consideration; <br />consider discretionary funds to protect municipal corporation and not official. Noted that <br />actions would have to be considered by the full City Council.
