For maintaining and cleaning the on -site drainage facilities and shall keep <br />the drainage facilities free and clear of all impediments to drainage. <br />(6) Developer shall relocate the two utility poles and guy wires located <br />between Berkeley Street and Occidental Street as shown on Exhibit 10 <br />attached hereto and incorporated herein by this reference" <br />15. Section 12, Off -Site larking Mitigation, subsection (a) of the Development <br />Agreement shall hereby be amended to read as follows: <br />"(a) The patties hereto acknowledge and agree that the students attending the <br />school park their automobiles on the local streets in neighboring residential areas; that the <br />approval of this Development Agreement will not exacerbate that situation because this <br />Development Agreement limits the number of students attending tho school to 2,500 <br />students; but that this Development Agreement allows the parties to jointly mitigate the <br />student parking problem that will continue to exist unless mitigated by the provision of <br />additional off- street parking areas. Therefore, the parties agree to undertake the <br />off - street parking mitigation treasures set forth in subsections (b) and (c) of this section." <br />16. Except as amended by this Second Amendment, all the terms, conditions and <br />agreements of the Development Agreement and all exhibits and attachments thereto, including <br />the Amendment to Development Agreement and all exhibits and attachments thereto, shall <br />remain in full force and effect, and each such to=, covenant, and condition is incorporated <br />herein by reference as thotigh set forth in frill. <br />17. This Second Amendment may be executed in counterparts which, when both of <br />the parties hereto have signed this Second Amendment, shall constitute an original, <br />18. The Development Agreement, originally adopted on August 21, 1995, as <br />amended on June -21, 1999, and as again amended by this Second Amendment, is hereby <br />accepted by the City and Developer, and it will be administered in the State of California, and its <br />validity, construction, and all rights thereunder shall be governed by the laws of such state, <br />75D -27 <br />
