Administrative Plan 4/1/2016 Page 12-2 <br />PART I: GROUNDS FOR TERMINATION OF ASSISTANCE <br />12-I.A. OVERVIEW <br />HUD requires SAHA to terminate assistance for certain actions and inactions of the family and <br />when the family no longer requires assistance due to increases in family income. HUD permits <br />SAHA to terminate assistance for certain other actions or inactions of the family. In addition, a <br />family may decide to withdraw from the program and terminate their HCV assistance at any time <br />by notifying SAHA. <br />12-I.B. FAMILY NO LONGER REQUIRES ASSISTANCE [24 CFR 982.455] <br />As a family’s income increases, the amount of the housing assistance payment decreases. If the <br />amount of assistance provided by SAHA is reduced to zero, the family's assistance terminates <br />automatically 180 days after the last HAP payment. <br />SAHA Policy <br />If a participating family receiving zero housing assistance experiences a change in <br />circumstances that would cause the HAP payment to rise above zero, the family must <br />notify SAHA of the changed circumstances and request an interim reexamination before <br />the expiration of the 180-day period. <br /> <br /> <br />12-I.C. FAMILY CHOOSES TO TERMINATE ASSISTANCE <br />The family may request that SAHA terminate housing assistance payments on behalf of the <br />family at any time. <br />SAHA Policy <br />The request to terminate assistance must be made in writing and signed by the head of <br />household, spouse, or co-head. Before terminating the family’s assistance, SAHA will <br />follow the notice requirements in Section 12-II.E. <br /> <br />12-I.D. MANDATORY TERMINATION OF ASSISTANCE <br />HUD requires SAHA to terminate assistance in the following circumstances. <br />Eviction [24 CFR 982.552(b)(2), 24 CFR 5.2005(c)(1)] <br />SAHA must terminate assistance whenever a family is evicted from a unit assisted under the <br />HCV program for a serious or repeated violation of the lease. As discussed further in section 12- <br />II.E, incidents of actual or threatened domestic violence, dating violence, sexual assault, or <br />stalking may not be construed as serious or repeated violations of the lease by the victim or <br />threatened victim of such violence or stalking. <br />SAHA Policy <br />A family will be considered evicted if the family moves after a legal eviction order has <br />been issued, whether or not physical enforcement of the order was necessary. <br />3-278
