Administrative Plan 4/1/2016 Page 17-13 <br />Pre-HAP Contract Inspections [24 CFR 983.103(b)] <br />SAHA must inspect each contract unit before execution of the HAP contract. SAHA may not <br />enter into a HAP contract covering a unit until the unit fully complies with HQS. <br />Turnover Inspections [24 CFR 983.103(c)] <br />Before providing assistance to a new family in a contract unit, SAHA must inspect the unit. <br />SAHA may not provide assistance on behalf of the family until the unit fully complies with <br />HQS. <br />Annual/Biennial Inspections [24 CFR 983.103(d); FR Notice 6/25/14] <br />At least once every 24 months during the term of the HAP contract, SAHA must inspect a <br />random sample consisting of at least 20 percent of the contract units in each building to <br />determine if the contract units and the premises are maintained in accordance with HQS. <br />Turnover inspections are not counted toward meeting this inspection requirement. <br />SAHA Policy <br />SAHA will inspect every unit on an annual basis according to the same procedures for <br />the regular tenant-based program. <br />If more than 20 percent of the sample of inspected contract units in a building fail the initial <br />inspection, SAHA must reinspect 100 percent of the contract units in the building. <br />Other Inspections [24 CFR 983.103(e)] <br />SAHA must inspect contract units whenever needed to determine that the contract units comply <br />with HQS and that the owner is providing maintenance, utilities, and other services in <br />accordance with the HAP contract. SAHA must take into account complaints and any other <br />information coming to its attention in scheduling inspections. <br />SAHA must conduct follow-up inspections needed to determine if the owner (or, if applicable, <br />the family) has corrected an HQS violation, and must conduct inspections to determine the basis <br />for exercise of contractual and other remedies for owner or family violation of HQS. <br />In conducting SAHA supervisory quality control HQS inspections, SAHA should include a <br />representative sample of both tenant-based and project-based units. <br />Inspecting PHA-Owned Units [24 CFR 983.103(f)] <br />In the case of SAHA-owned units, the inspections must be performed by an independent agency <br />designated by SAHA and approved by HUD. The independent entity must furnish a copy of each <br />inspection report to SAHA and to the HUD field office where the project is located. SAHA must <br />take all necessary actions in response to inspection reports from the independent agency, <br />including exercise of contractual remedies for violation of the HAP contract by SAHA-owner. <br /> <br /> <br /> <br />3-401
