5. LABORATORY RESULTS <br />The paint chip sample results are contained in Section 2. CALIFORNIA PERTINENT REGULATIONS ON LBP <br />Pursuant to Cal /OSHA Lead in Construction Standard Title 8, CCR Section 1512. 1, <br />(A) With respect to the lead related tasks listed in subsection (d)(2)(A), where lead is <br />present, until the employer performs an employee exposure assessment as required in <br />subsection (d) and documents that the employee performing any of the listed tasks is <br />not exposed above the PEL, the employer shall treat the employee as if the employee <br />were exposed above the PEL, and not in excess of ten (10) times the PEL, and shall <br />implement employee protective measures prescribed in subsection (d)(2)(E). The tasks <br />covered by this requirement are: <br />(B) 1. Where lead containing coatings or paint are present: manual demolition of <br />structures (e.g., dry wall), manual scraping, manual sanding, heat gun applications, and <br />power tool cleaning with dust collection systems; <br />7. CONCLUSIONS & RECOMMENDATIONS <br />As shown in the attached Section I Positive Results by Location, numerous interior and <br />exterior components tested positive for the presence of LBP via XRF testing Moreover, <br />various components tested lead positive via paint chip AAS testing. <br />Because the Residence will be demolished via mechanical means, there is no federal <br />or state regulation that mandates removal of lead paint prior to demolition. LTE <br />advises that the demolition company should confirm this assessment with the <br />following: California EPA, CAL /OSHA, SCAQMD and the California Department <br />of Public Health (CDPH). The Residence should be misted prior to demolition. <br />Moreover, the driver of the bulldozer should have training in lead based paint <br />abatement, and wear appropriate personal protective equipment such as a HEPA <br />respirator, Tyvec suit, etc. <br />8. HAZARDOUS WASTE <br />The California Environmental Protection Agency (CAL /EPA) states that waste streams <br />generated during lead abatement or construction jobs that might disturb components <br />coated with lead based paint (e.g. paint chips, sludge, polyethylene sheeting, etc.) are <br />subject to waste characterization requirements, and possibly disposal as hazardous waste. <br />19F-2110 <br />
