Councilmember Benavides, pointed out that he was not in support of measure <br />to legalize dispensaries; staff has been intentional of regulating and pleased <br />with management and process to date; asked that staff engage with operators <br />and consider some of their requests as submitted and brought up at the <br />Public Safety Council Committee. <br />Mayor Pro Tem Sarmiento, said that City Council enforcing voter's will which <br />was passed by 65% margin; thanked staff for reducing number of illegal <br />operators; pointed out that State has referendum on the ballot that will be <br />considered this election; Municipal Code provides for revisions to the process; <br />concerned that currently no deadlines set to complete the application process <br />— can't keep spot indefinitely because we can't enforce the illegal operators <br />without revenues generated from legal businesses; staff to consider <br />extending additional 6 months to allow them to exercise their rights and apply <br />for regulatory application; after that period may have to cleanse the list and <br />wait list at some point; requested Work Study Session on signage, hours of <br />operation, inventory, quality control, potential cultivation, and other ancillary <br />businesses. <br />City Attorney Carvalho, said that extension of time was considered by staff <br />and is more equitale since initiatly time frame not identified. <br />City Manager Cavazos, indicated that with concurrence of City Attorney <br />additional 120 days is more favorable. <br />Councilmember Benavides, asked that in the future we identify a nexus <br />between illegal operators and those applying for permit that should be <br />deemed disqualified. <br />City Attorney Carvalho, held that the issue had been considered in the past <br />and may be incorporated in the future. <br />Councilmember Martinez, asked if additional changes to the ordinance may <br />be made when second reading of ordinance returns. Was informed that any <br />changes to the ordinance would require re- introduction; concerned that full <br />participation did not occur on proposed amendments. <br />Mayor Pro Tern Sarmiento, indicated that Public Safety Council Committee <br />has discussed and staff has met with business representatives; additional <br />changes may be considered after work study session. <br />Councilmember Martinez, happy to host Town Hall meeting along with Mayor <br />Pro Tern and Chair of Public Safety Council Committee to discuss requests <br />received. <br />FRIENDLY AMENDMENT: <br />CITY COUNCIL MINUTES 15 APRIL 5, 2016 <br />1 0A -15 <br />
