Authorize the Planning Commission to issue a Public Convenience and Necessity (PCN) letter. <br />Request of Applicant <br />Oscar Olivares, representing Mariscos Hector, is requesting approval of a conditional use permit <br />(CUP) for a Type 47 Alcoholic Beverage Control (ABC) license to allow the on -premise sale and <br />consumption of beer, wine, and distilled spirits at the Mariscos Hector restaurant, located at 409 <br />North Broadway. In addition, the applicant is requesting approval of a separate conditional use <br />permit that would allow the restaurant to operate until 2:00 a.m. <br />Establishments that sell alcoholic beverages and that wish to operate between 12:00 midnight <br />and 7:00 a.m. require respective conditional use permits pursuant to Section 41-2007 of the <br />Santa Ana Municipal Code (SAMC). <br />Prolect Location and Site Description <br />The applicant is currently constructing tenant improvements to open a new eating establishment at <br />409 North Broadway. The building is located mid -block on North Broadway, between Fifth Street <br />to the north and Fourth Street to the south and is developed with a 5,150 -square -foot, two-story <br />building that contains commercial/office uses.
