INS URAN(,E (iN 4lL K;: <br />WOnK MAY PROCEED <br />UNTIL INS 1 AN SFX IHfaS <br />%��o <br />CLERK Or <br />"'T'*FFD 2�1a <br />FOURTH AMENDMENT TO LANDSCAPE <br />AND MAINTENANCE AGREEMENT <br />A-2014-015-01 <br />THIS FOURTH AMENDMENT TO LANDSCAPE AND MAINTENANCE AGREEMENT is <br />entered into this 13TH day of January 2016, by and between Mariposa Landscapes, Inc. a California <br />corporation ("Contractor"), and the City of Santa Ana, a charter city and municipal corporation duly <br />organized and existing under the Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Landscape and Maintenance Agreement No. A-2014-015, <br />("Agreemen(") dated, January 6, 2014, by which Contractor has provided park landscape <br />maintenance services for Santa Ana Parks District 3, covering eleven (11) City properties. <br />E. The parties have executed three amendments to the Agreement, Nos. A-2014-271, A-2015-008, <br />and A-2015-028, respectively, through which the scope of services, compensation, and terms <br />have been amended. <br />C. The current term of the Agreement is for the period from February 1, 2015 through January 31, <br />2016, and the Agreement remains in effect. <br />D. The parties now wish to further amend the Scope of Services, Compensation, and Term clauses <br />of the Agreement by removing District 4 from the services to be performed by Contractor, <br />adjusting the compensation accordingly, and extending the term of the Agreement for one year, <br />The Parties therefore agree: <br />1. Section 1, SCOPE OF SERVICES, is amended by deleting all services for and references to <br />District 4, effective February 1, 2016. <br />2. Section 3, COMPENSATION, is amended by deleting any and all compensation payments for <br />services to District 4, effective February 1, 2016, <br />3. Section 4, TERM, is amended to extend the term of the Agreement for an additional one (1) <br />year period, from. February 1, 2016 to January 31, 2017. <br />4. Except as modified by this Fourth Amendment, and all prior amendments, all terms and <br />conditions of the Agreement remain unchanged and in Rill force and effect, <br />IN WITNESS WHEREOF, the parties hereto have executed this Fourth Amendment to the Agreement <br />the date and year first above written, <br />Page 1 of 2 <br />
