Section 5 <br />or more per year of greenhouse gas emissions are required to submit annual <br />reports to the EPA. <br />Greenhouse Gas Endangerment <br />On December 7, 2009, the EPA Administrator signed two distinct findings <br />regarding greenhouse gases under § 202(a) of the Clean Air Act: 1 ) Current and <br />projected concentrations of the six key well-mixed greenhouse gases—carbon <br />dioxide, methane, nitrous oxide, hydrofluorocarbons, perfluorocarbons, and sulfur <br />hexafluloride in the atmosphere threaten the public health and welfare of current <br />and future generations-, 2) The combined emissions of these well-mixed <br />greenhouse gases from new motor vehicles and new motor vehicle engines <br />contribute to the greenhouse gas pollution, which threatens public health and <br />welfare. <br />State Regulations <br />Assembly Bill AB 32 <br />The California State Legislature enacted AB 32, the California Global Warming <br />Solutions Act of 2006. AB 32 requires that greenhouse gases emitted in <br />California be reduced to 1990 levels by the year 2020. "Greenhouse gases" as <br />defined under AB 32 include carbon dioxide, methane, nitrous oxide, <br />hydrof[Llorocarbons, perfluorocarbons, and sulfur hexafluoride. ARB is the state <br />agency charged with monitoring and regulating sources of greenhouse gases. <br />The ARB's Climate Change Scoping Plan (Scoping Plan) contains measures <br />designed to reduce the State's emissions to 1990 levels by the year 2020. The <br />Scoping Plan identifies recommended measures for multiple greenhouse gas <br />emission sectors and the associated emission reductions needed to achieve the <br />year 2020 emissions target. Most of the measures target the transportation and <br />electricity sectors. In addition, the Scoping Plan differentiates between "capped" <br />and "uncapped" strategies. "Capped" strategies are Subject to the proposed cap- <br />and-trade program. The Scoping Plan states that the inclusion of these <br />emissions within the cap-and trade program would help ensure that the year <br />2020 emission targets are met despite some degree of uncertainty in the <br />emission reduction estimates for any individual measure. Implementation of the <br />capped strategies is calculated to achieve a suffiicient amount of reductions by <br />2020 to achieve the emission target contained in AB 32.
