Adopt an ordinance approving Zoning Ordinance Amendment No. 2016 -01. <br />PLANNING COMMISSION ACTION <br />At its regular meeting on May 23, 2016, a vote of 6:0 (Bacerra absent), the Planning Commission <br />recommended that the City Council adopt an ordinance approving Ordinance Amendment No. <br />2016 -01 to revise Santa Ana Municipal Code (SAMC) Chapter 22 — Massage Establishments and <br />adopt an ordinance approving Zoning Ordinance Amendment No. 2016 -01 to revise SAMC <br />Chapter 41, Article XVILI (Massage). The Planning Commission made no changes to the <br />modifications outlined in the attached staff report (Exhibit A). <br />DISCUSSION <br />The requested action will amend Sections 21 -1 through 22 -17 [Chapter 221 and 41 -1750 through <br />41 -1799 [Chapter 41, Article XVILI (Massage)] citywide to comply with new State legislation <br />pertaining to massage establishments. Massage establishments currently require either a <br />conditional use permit (CUP) or land use certificate (LUC) and a massage operator permit issued <br />through the Santa Ana Police Department to operate within the city. The requested amendments <br />will replace CUP and LUC requirements with a ministerial permit process and enforceable <br />operating standards. If adopted, massage establishments will be required to obtain an annual <br />massage establishment permit through the Chief of Police, a Certificate of Occupancy, and meet <br />operating and development standards to operate within the city. <br />75A -1 <br />
