J. <br />I — <br />SECTION IV — COMMERCIAL GENERAL LIABILITY CONDITIONS, paragraph 4. <br />Other Insurance, is amended as follows: <br />1. The following is added to subparagraph b: <br />Regardless of whether other insurance is available to an additional insured on a primary basis, <br />this insurance will be primary and noncontributory, if a written contract or agreement <br />between you and the additional insured specifically requires that this insurance be primary. <br />2. Condition 8. Transfer of Rights of Recovery Against Others To Us is amended by adding <br />the following: <br />We waive any right of recovery we may have against any person or organization when such <br />waiver is required by a written contract that you have agreed to prior to loss. <br />Exclusion: <br />With respect to the insurance afforded the additional insured by this endorsement, the following <br />additional exclusion applies: <br />This insurance does not apply to: <br />1. "Bodily injury" or "property damage" occurring after: <br />a. all work, including materials, parts or equipment furnished in connection with such <br />work, on the project (other than service, maintenance or repairs) to be performed by <br />or on behalf of the additional insured(s) at the site of the covered operations has been <br />completed; or <br />b. that portion of "your work" out of which the injury or damage arises has been put to <br />its intended use by any person or organization other than another contractor or <br />subcontractor engaged in performing operations on or at the same project. <br />2. `Bodily injury," "property damage," "personal and advertising injury" caused by the <br />rendering of or failure to render any professional services. <br />3. Any claims, including but not limited to those for "bodily inj ury," "property damage" and/or <br />"personal and advertising injury," arising under the federal Telephone Consumer Protection <br />Act (47 U.S.C.A. 227) and/or claims made under any similar, related, and/or equivalent state <br />law and/or any claims related to telephonic solicitations, electronic solicitations, <br />telemarketing, automatic dialing systems, artificial voice messages, pre-recorded voice <br />messages, short message service, texting, and/or use of fax machines. <br />All other terms and conditions of this policy shall remain unchanged.
