and the replacing of, or making acceptable, any defective materials or faulty <br />workmanship. No alterations, time extensions, additional work or other changes <br />authorized by the Agreement or the contract may be made without securing consent of <br />the surety or sureties on the Bonds. <br />Contractor to provide payment bond(s) in an amount deemed the by Project <br />Representatives as sufficient to guarantee the Contractor's faithful performance of <br />contract obligations, including those required for warranties and any performed post - <br />construction. <br />Required Warranties <br />Contractor to warrant that materials and equipment furnished be new or good <br />quality and carry all available manufacturer's and installer's warranties and that <br />construction be of good and workmanlike quality in accordance with the terms of this <br />Agreement for a period of three years from completion of Project construction and the <br />sign -off date on applicable CPP(s). Any work not conforming to these requirements shall <br />be considered defective work. The construction contract shall not limit the time that <br />owner of improvements has to pursue any action for defective work for a time period less <br />than the applicable statute of limitations. <br />II. Operation and Maintenance <br />An O &M contractor(s) shall maintain and provide OCFCD and /or COSTA MESA, with <br />proof of insurance for coverage, at minimum, as set forth below: <br />Covera¢e /Limits <br />Coverage <br />Minimum Limits <br />Commercial General Liability with <br />products and completed operations and <br />contractual liability <br />$1,000,000 limit per occurrence <br />$1,000,000 aggregate <br />Automobile Liability including coverage <br />for owned, non -owned and hired vehicles <br />$1,000,000 limit per occurrence <br />Workers' Compensation <br />Statutory <br />Employer's Liability Insurance <br />$1,000,000 limit per occurrence <br />Required Coveraee Forms <br />The Commercial General Liability coverage shall be written on Insurance Services Office (ISO) <br />form CG 00 01, or a substitute form providing liability coverage at least as broad. <br />The Business Auto Liability coverage shall be written on ISO form CA 00 01, CA 00 05, <br />CA 00 12, CA 00 20, or a substitute form providing liability coverage as broad. <br />Qualified Insurer <br />The policy or policies of insurance must be issued by an insurer licensed to do business in <br />Santa Ana -Delhi Channel Diversion Project Agreement D15-013 <br />25G -77 <br />Page 73 of 74 <br />
