Each participating agency shall have Hill financial responsibility for their respective <br />personnel assigned, including any liability for the negligent or intentional acts or omissions <br />of their personnel, vehicle accidents, and industrial injury claims. Additionally, the agency <br />shall be responsible for any and all workers' compensation claims of their respective <br />personnel in the event of injury during the course and scope of their duties while assigned to <br />the ProAct Task Force. <br />The County of Orange, its officers, agents, and employees shall not be deemed to have <br />assumed any liability for the negligent or intentional acts or omissions of participating <br />agencies, officers, or employees. <br />E. Coin plain ts/investigations <br />Evaluation and investigations of citizen's complaints against assigned personnel and internal <br />investigations shall be handled by the parent agency. <br />Disciplinary actions will be approved solely by the parent agency. The parent agencies will <br />provide the name, rank, and telephone number of a "liaison supervisor" who will assist the <br />Program Manager with inquires of mutual concern. <br />Continued failure to abide by the policies and procedures may result in removal from the <br />ProAct Task Force at the recommendation of the Program Manager with concurrence of the <br />Council. <br />VI. PROACT TASK FORCE FUNDIN(; <br />The operations shall be funded in part, as described herein, by the Sheriff's Department, as <br />well as proceeds received through the Equitable Sharing process. These funds shall be <br />expended and disbursed in support of law enforcement operations, to include but are not <br />limited to; clandestine laboratory responses, joint operations or training, specialized <br />equipment, forensic services, permissible use expenses incurred due to outside agency <br />assistance, mutual aid response, and any and all other law enforcement related expenses with <br />ProAct Task Force management authorization. <br />The Council may allocate funds to other agreed upon appropriations, within the permissible <br />use guidelines, which governs the ProAct Task Force. <br />A. Fiscal Procedures. <br />1. Salaries and Benefits — The participating agencies will be responsible for the salaries and <br />related benefits of all personnel assigned. <br />2. Overtime — Funds, may reimburse overtime expenditures related to personnel assigned, <br />other law enforcement personnel having an investigative support response to the ProAct <br />Task Force mission, nonsworn personnel in support of the mission and mutual aid <br />responses. Overtime reimbursement wilt be based on the permissible uses of the ProAct <br />Task Force. <br />3. Right to Audit — Each party to this agreement shall make available to authorized <br />representatives of the County of Orange, at afl reasonable times, its payroll and other <br />records related to this agreement. The County or an independent auditor may audit such <br />ProAct MOU Effective July 1, 2016 <br />7 <br />
