Approve the proposed Amended and Restated Solid Waste Services Agreement with USA <br />Waste of California, Inc. (dba Waste Management of Orange County). <br />2. Authorize the City Manager to explore the pros and cons of a possible extension of the Solid <br />Waste Services Agreement with USA Waste of California, Inc. (dba Waste Management of <br />Orange County) for Council's future discussion and direction. <br />DISCUSSION <br />On June 30, 1993, at the completion of a Request for Proposals process, the City entered into an <br />agreement with Great Western Reclamation for solid waste collection and handling. <br />Subsequently, there were 13 separate Council- approved amendments and resolutions in order <br />to, among other things, establish fees, implement the 3 -cart curbside trash collection service, and <br />to extend the agreement term. The most recent of these amendments was approved on June 1, <br />2009. <br />In December 2015, the City Council approved a consultant services agreement to analyze the <br />City's solid waste services rates and level of service in comparison with comparable cities in <br />Orange County. In addition to analyzing the services, the consultant was also tasked with <br />providing an analysis of the options for either a new or extended contract. During this process, <br />the City Attorney recommended restating all amendments to the current solid waste services <br />agreement into a single Amended and Restated Agreement ( "Proposed Agreement "), and <br />clarifying the pass - through and impact fees, for tracking and transparency purposes, as well as <br />compliance with State legal requirements (Exhibit 1). <br />The Proposed Agreement does not present any new terms or conditions, nor are there any <br />customer rate changes. The current agreement terms will remain the same, along with any <br />25E -1 <br />
