PUBLIC HEARINGS <br />1. CONDITIONAL USE PERMIT NO. 2016-29, CONDITIONAL USE PERMIT NO. <br />2016-30 AND CONDITIONAL USE PERMIT NO. 2016-33 <br />(Applicant. Andy Quach, The Majesty Restaurant - 5015 W. Edinger Ave., Unit V) <br />Legal notice published in the Orange County Register on September 2, 2016 and <br />notices mailed September 1, 2016. <br />A project overview was provided by Vince Fregoso, Principal Planner, for <br />Conditional Use Permit No. 2016-29 to allow the on -premise sale of alcoholic <br />beverages, Conditional Use Permit 2016-30 for allow the restaurant to operate until <br />2:00 a.m.; and Conditional Use Permit No. 2016-33 to allow an ancillary banquet <br />use. Chairperson Verino opened the public hearing. Written communication <br />received in opposition of the project from Dick Blumer, Lorraine Roy, Thu Vu, and a <br />petition signed by 20 residents. Phone call from Julie Melcher in opposition. Tung <br />Le spoke in opposition of the project citing current illegal concerns, noise, difficulty <br />parking, current problem would be worse with after-hours, concern that restaurant <br />will become a nightclub, and presented a petition and copies of flyers of concerts <br />held at the site. Tracy Thuy Trang spoke in opposition of after-hours operation <br />noting they are currently operating those hours with alcohol served. Andy Quach, <br />applicant, spoke in support of the project, provided background information and <br />improvements made on the site adding they would like to come in compliance. There <br />were no additional speakers and the hearing was closed. <br />Commission discussion on police callouts, events at the location, previous <br />conditional use permit, entertainment permits, alcohol ordinance, requested staff to <br />make sure there are conditions reflective of the sensitive uses around the site to the <br />north and east. <br />MOTION: <br />Continue the matter to October 10, 2016 in order to obtain analysis/statistics <br />report from the Police Department with dates and times and review previous <br />conditional use permit for the property. <br />MOTION: Alderete SECOND: Bacerra <br />VOTE: AYES: Alderete, Bacerra, Bauer, McLoughlin, Mendoza, Verino (6) <br />NOES: None (0) <br />ABSTAIN: None (0) <br />ABSENT: Gartner (1) <br />2. Chairperson <br />Verino opened the public hearing. Maria Diaz, applicant, spoke in support of the <br />project.
