Conditional Use Permit No. 2016-12 <br />September 26, 2016 <br />Page 4 <br />State for high crime. The Police Department contends that the conditions of approval and operational <br />standards applicable to after-hours operations will mitigate any potential negative impacts to the <br />surrounding community. Further, the use will operate indoors, minimizing potential noise impacts <br />associated with an after-hours use. <br />Public Notification <br />The project site is located within the Casa de Santiago Neighborhood Association and in close <br />proximity to the Bristol Memory Coalition Neighborhood Association, Morrison/Eldridge Park <br />Neighborhood Association, and Fisher Park Neighborhood Association. Staff notified the <br />representatives of the neighborhood associations, who identified no concerns with the proposed <br />project. The project site was posted with a notice advertising this public hearing, a notice was <br />published in the Orange County Reporter and notices were sent to all property owners and occupants <br />within 500 feet of the project site. At the time of this printing, written and electronic communications <br />stating concerns with the subject project had been received from respective members of the public. <br />CEQA Compliance <br />In accordance with the California Environmental Quality Act (CEQA) the recommended action is <br />exempt from CEQA per Section 15061(b)(3). This exemption applies to projects where it can be <br />seen with certainty that there is no possibility that the activity in question may have a significant <br />effect on the environment. The project proposes to allow the 24-hour operation of an existing retail <br />market from an existing structure. No expansion of square footage or modification to the exterior <br />of the building is proposed as part of this project. Therefore, it can be seen with certainty that there <br />is no possibility that the activity in question will have a significant effect on the environment. <br />Strategic Plan Alignment <br />Approval of this item supports the City's efforts to meet Goal No. 3 - Economic Development, <br />Objective No. 2 (create new opportunities for business/job growth and encourage private <br />development through new General Plan and Zoning Ordinance policies). <br />Conclusion <br />Based on the analysis provided within this report, staff recommends that the Planning Commission <br />approve Conditional Use Permit No. 2016-12 as conditioned. <br />Ricardo Soto <br />Associate Planner <br />RS:jm <br />RS:Reports\CUP 2016-12\2626 North Bristol St — CUP 2016-12.092616.pc <br />31A-6 <br />
