A-2016-232 <br />I <br />SERVICE AGREEMENT <br />ROTATIONAL TOW PROVIDER <br />t THIS AGREEMENT, made and entered into this 16th day of August, 2016 by <br />-c and between Greater Southern California Towing, Inc., a California corporation doing <br />i} business as California Tow {hereinafter "Contractor", and the City of Santa Ana, a <br />charter city and municipal corporation organized and existing under the Constitution and <br />laws of the State of California (hereinafter "City"), <br />RECITALS <br />;.l <br />A. The City desires to retain a contractor having special skill and knowledge in the held <br />of providing vehicle towing and storage services. <br />B. Contractor represents that it is able and willing to provide such services to the City. <br />C. In undertaking the performance of this Agreement, Contractor represents that it is <br />knowledgeable in its field and that any services performed by Contractor under this <br />Agreement will be performed in compliance with such standards as may reasonably <br />be expected from a professional consulting firm in the field. <br />NOW THEREFORE, in consideration of the mutual and respective promises, and <br />subject to the terms and conditions hereinafter set forth, the parties agree as follows: <br />1. SCOPE OF SERVICES <br />Contractor shall provide vehicle towing and storage service at the request of the <br />Santa Ana Police Department, on a rotational basis, in accordance with the terms and <br />conditions set forth in the Scope o f Service, attached hereto as Exhibit A and <br />incorporated by this reference. The City intends to contract with several tow companies <br />to provide necessary towing services on, a rotational basis. Towing services may include, <br />but are not limited to, towing vehicles from public or private property at the direction of <br />Police employees, owner's request for a tow made via the Police Department, the storage <br />of vehicles, the secure storage of vehicles containing evidentiary value, debris clean-up <br />and removal, recovery services and administrative oversight of vehicles in the custody of <br />the contractor. <br />2. COMPENSATION <br />a. The parties intend that towing and storage fees will be paid by the vehicle <br />owner at the rates and charges set forth in Contractor's then current and approved fee <br />schedule, attached as Exhibit B and incorporated by this reference. <br />b. when Contractor provides services chargeable to the City as set forth in Exhibit <br />A, the Contractor shall submit a monthly invoice by the 15th of the month to the City for <br />
