I <br />1HOURANCE ON I'M' A-2016-103 <br />WORK MAY PNOCEEU <br />UNTIL INSURANCE EXPIRES <br />CLERK OP COUNCIL <br />DATE: 6-16 —/% <br />SECOND AMENDMENT TO AGREEMENT TO <br />PROVIDE BATTERY RECYCLING <br />THIS SECOND AMENDMENT TO AGREEMENT is entered into this 4TH day of May, 2016, by <br />and between WMCurbside, Inc. ("Consultant"), and the City of Santa Ana, a charter city and municipal <br />corporation duly organized and existing under the Constitution and laws of the State of California ("City"). <br />RECITALS <br />A. The parties entered into Agreement N-2007-086, dated July 1, 2007, to provide Small <br />Battery Recycling. <br />B. On September 1, 2009, the parties executed an Amendment N-2007-086-001, to extend <br />the term of the agreement. <br />C. In accordance with the terms and conditions of the Agreement, the parties desire to amend <br />the compensation and extend the Tenn of the Agreement. <br />WHEREFORE, in consideration of the covenants contained in the Agreement, and subject <br />to all the terms and conditions of the Agreement, except those amended by the Amendment <br />and this Second Amendment, the parties agree as follows: <br />1. Section 2, COMPENSATION, shall be amended to increase compensation in the <br />amount not to exceed $25,000.00, to pay for the additional services during the extended <br />term. <br />2. Section 3, TERM, shall be amended to extend the term of said Agreement period to June <br />30, 201$. <br />Except as hereinabove modified, the terms and conditions of said Agreement remain <br />unchanged and in full force and effect. <br />IN WITNESS WHEREOF, the parties hereto have executed this Second Amendment to the <br />Agreement the date and year first above written. <br />ATTEST: <br />MARIA D.
