II -D. This Inclusionary Housing Agreement is, and all agreements, instruments <br />and documents to be executed by the Developer pursuant to this <br />Inclusionary Housing Agreement shall be duly executed by, and to the <br />best of the Developer's knowledge, are or shall be valid and legally <br />binding upon the Developer and enforceable in accordance with their <br />respective terms. <br />III. Effective Date <br />This Inclusionary Housing Agreement is dated August 31, 2016 for reference <br />purposes only. This Inclusionary Housing Agreement shall not go into effect <br />before the Effective Date. <br />IV. Recitals <br />The Recitals set forth above are true and correct. The Recitals are incorporated <br />into this Inclusionary Housing Agreement in their entirety by this reference. <br />V.
