Program Specific Terms and Conditions <br />44. Participants <br />A. Eligibility. Only participants who have been determined to meet all federal eligibility <br />requirements to receive training hereunder shall be enrolled by CONTRACTOR in <br />any occupational training. Determinations that participants meet federal eligibility <br />requirements shall be made by One Stop Centers funded by COUNTY, and, when <br />applicable, by WIOA Service Providers. <br />B. Benefits. Benefits shall be provided to participants in accordance with the <br />standards and requirements set forth in the Act, including Section 181. <br />C. Rights and Privileges. All participants enrolled in courses pursuant to the <br />CONTRACT shall be entitled to all the rights and privileges to which other <br />CONTRACTOR students are entitled, including, but not limited to, special <br />instruction, use of facilities on CONTRACTOR's premises such as the libraries and <br />learning centers, counseling, student body activities, and veterans' benefits. <br />CONTRACTOR's representatives will provide academic counseling for <br />participants and inform them of CONTRACTOR's services available to them. <br />D. Labor Standards. CONTRACTOR shall adhere to the Labor Standards described <br />in the Act, including Section 181 of the Act, and all other applicable codes and <br />regulations. <br />45. Policies and Procedures: CONTRACTOR shall monitor its program for compliance with <br />the provisions of this CONTRACT. CONTRACTOR shall also comply with all applicable <br />parts of COUNTY'S WIOA Policies and Procedures for recruitment, intake, assessment <br />and referral, copies of which are available from COUNTY'S PROJECT MANAGER. <br />46. Budget Schedule <br />CONTRACTOR agrees that the expenditures of any and all funds under this CONTRACT <br />will be in accordance with the Budget Schedule, a copy of which is attached hereto as <br />Attachment C, and which by this reference is incorporated herein and made a part hereof <br />as if fully set forth. <br />47. Modification of Budget Schedule <br />A. Upon written approval of CONTRACT MANAGER, CONTRACTOR shall have the <br />authority to transfer allocated program funds from one category of the overall <br />program budget to any other category of the overall program budget, as long as <br />the amount of the total contract is not increased and the basic goals and objectives <br />of the program are not altered. No such transfer may be made without the express <br />prior written approval of CONTRACT MANAGER. A modification of the Budget <br />Schedule may include the addition of any new budget category. Approval of the <br />Budget Modification by CONTRACT MANAGER includes approval of the new <br />Budget Category. Budget modifications are limited to once each Quarter. <br />B. CONTRACTOR may submit a program or budget modification request in response <br />to the modification of program components and/or service levels which significantly <br />alter CONTRACTOR's Scope of Services. Without further Board action, <br />DIRECTOR may execute amendments to this CONTRACT modifying <br />CONTRACTOR's services in amounts that do not collectively increase by more <br />than ten percent (10%) the price of said services under this CONTRACT when <br />originally executed.
