D. To purchase a policy or policies of insurance covering loss or damage to any <br />and all Equipment purchased under this CONTRACT, in the amount of the full <br />replacement value thereof, providing protection against the classification of fire, <br />extended coverage, vandalism, malicious mischief and special extended perils <br />(all risks) covering the PARTIES' interests as they appear. <br />E. The purchase of any Equipment by CONTRACTOR shall be requested by <br />CONTRACTOR in writing, shall require the prior written approval of DIRECTOR <br />and shall fulfill the provisions of this CONTRACT which are appropriate and directly <br />related to CONTRACTOR's service or activity under the terms of this CONTRACT. <br />COUNTY may refuse reimbursement for any costs resulting from Equipment <br />purchased, which are incurred by CONTRACTOR, if prior written approval has not <br />been obtained from COUNTY'S PROJECT MANAGER. <br />52. Compliance with COUNTY WIOA Policies and Procedures: If any services under this <br />Agreement are funded by WIOA, CONTRACTOR shall comply with all applicable parts of <br />COUNTY's WIOA Policies and Procedures. Said Policies and Procedures may be <br />modified by COUNTY's PROGRAM MANAGER upon ten (10) days written notice to <br />CONTRACTOR. <br />53. Publication: No copies of sketches, schedules, written documents, computer based data, <br />photographs, maps or graphs, including graphic art work, resulting from performance or <br />prepared in connection with this CONTRACT, are to be released by CONTRACTOR <br />and/or anyone acting under the supervision of CONTRACTOR to any person, partnership, <br />company, corporation, or agency, without prior written approval by the COUNTY, except <br />as necessary for the performance of the services of this CONTRACT. All press releases, <br />including graphic display information to be published in newspapers, magazines, etc., are <br />to be administered only by the COUNTY unless otherwise agreed to by both PARTIES. <br />54. Approved Scope of Services: This CONTRACT is based upon the information and <br />representations contained in Attachment B, CONTRACTORS's approved Scope of <br />Services. CONTRACTOR agrees to comply with all provisions, to perform all work, and <br />to provide all services set forth in this CONTRACT. The specific program components to <br />be performed by CONTRACTOR and the service levels to be utilized by COUNTY for <br />program evaluation and monitoring include, but are not limited to, those listed in <br />Attachment B hereto. Services to be provided hereunder shall be restricted to those <br />described in Attachment B. <br />55. Instructors: CONTRACTOR shall ensure that every instructor involved in the training of <br />participants hereunder shall be qualified to instruct in the program or training component <br />in which he/she acts as an instructor, and that every instructor required to be certified or <br />licensed is appropriately certified or licensed by the State or other licensing or certifying <br />authority. <br />56. Other Requirements — Program Confidentiality <br />A. Without prejudice to any other section of this CONTRACT, CONTRACTOR shall, <br />where applicable, maintain the confidential nature of information provided to it <br />concerning participants in accordance with the requirements of federal and State <br />law. However, CONTRACTOR shall submit to COUNTY, the State of California <br />and/or the United States government or their representatives, all records <br />requested for administrative purposes, including audits, examinations, monitoring <br />and verification of reports submitted by CONTRACTOR, costs incurred and <br />services rendered hereunder. <br />County of Orange Page 26 of 37 City of Santa Ana <br />OC Community Resources Contract FYs 221 WKhtessional-MI Contract # 16-28-0039-RWS <br />
