THIS FIRST AMENDMENT to the above -referenced agreement is entered into on November 15, 2016 by and between WKE, Inc., a California corporation ("Consultant'), and the City of Santa Ana, a charter city and municipal corporation organized and existing under the Constitution and laws of the State of California ("City"). RECITALS A. The parties entered into Agreement ##A-2014;348, dated December 2, 2014 ("Agreement"), by which Consultant agreed to provide professional engineering design services for the City's planned improvements to the Fairview Street Bodge. &. The term of the Agreement is from December 2, 2014 through December 1, 2016, and the Agreement remains in effect. C. The parties have worked together to secure grant funding for the project and now wish to amend the Agreement to extend its tern for an additional 3 -year period to allow for the completion of the project. The Parties therefore agree: Section 3, Term, is amended to extend the term of the Agreement for an additional 3 -year period, from December 2, 2016 through December 1, 20I9. 2. Except as modified by this First Amendment, all terms and conditions of the Agreement shall remain in full force and effect..
