AND <br />CONDITIONAL USE PERMIT NO. 2016 -33 TO <br />ALLOW AN ANCILLARY BANQUET USE AT <br />MAJESTY RESTAURANT LOCATED AT 5015 <br />WEST EDINGER AVENUE, UNIT V - ANDY QUACH, <br />APPLICANT <br />(STRATEGIC PLAN NO. 3,2) <br />CITY MANAGEIV <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />_W•c• 6 <br />CONTINUED TO <br />FILE NUMBER <br />Receive and file the staff report approving Conditional Use Permit No. 2016 -29, Conditional Use <br />Permit No. 2016 -30 as conditioned and Conditional Use Permit No. 2016 -33 as conditioned. <br />PLANNING COMMISSION ACTION <br />At its regular meeting on October 10, 2016, by a vote of 4:0 (Alderete, Gartner, Verino absent), <br />the Planning Commission adopted a resolution approving Conditional Use Permit No. 2016 -29 <br />which approved the sale of alcoholic beverages for on- premise consumption, Conditional Use <br />Permit No. 2016 -30 as conditioned to allow after -hours operation until 2:00 a.m., and Conditional <br />Use Permit No. 2016 -33 as conditioned to allow an ancillary banquet use at Majesty Restaurant <br />at 5015 West Edinger Avenue, Unit V located in the Community Commercial (C -1) zoning district. <br />The Planning Commission amended three conditions of approval limiting the distance sound can <br />be audible from the premises, restricting the hours of availability of the rear parking lot, and <br />limiting the hours the rear doors can be open as outlined in the attached staff report (Exhibit A). <br />DISCUSSION <br />The applicant is requesting a Conditional Use Permit (CUP) to allow the expansion of the existing <br />on- premise beer, wine and distilled spirits license for the Majesty Restaurant at 5015 West Edinger <br />Avenue, Unit V into the adjacent Unit Z. The applicant is also requesting a CUP to allow the after - <br />hours operation of the facility, until 2:00 a.m., seven days a week and a CUP to operate an ancillary <br />banquet use and allow the facility to be available for rent.
