Will the proposed use provide a service or facility which will <br />contribute to the general well being of the neighborhood and <br />community? <br />The existing restaurant provides a, service to the <br />surrounding properties, community, and employees in the <br />area. The sale of beer and wine for on- premise consumption <br />in conjunction with enclosed /private dining rooms may <br />result in additional Police incidents that would have a <br />negative impact on the well being of the neighborhood and <br />community. <br />B. Will the proposed use under the circumstances of the particular case <br />be detrimental to the health, safety or general welfare of persons <br />residing or working in the vicinity? <br />The proposed new liquor license at the Emerald Bay Seafood <br />Restaurant may have detrimental affects to persons residing or <br />working in the area without condition number A.B. to eliminate <br />the private dining room. These private rooms provide an <br />environment conducive to unlawful. activities that would create <br />new impacts on the surrounding land uses. <br />C. Will the proposed use adversely affect the present economic <br />stability or future economic development of properties <br />surrounding the area? <br />The removal of condition number A.B. related to the on- premise <br />sales of beer and wine at the Emerald Bay Seafood Restaurant is <br />anticipated to have an adverse impacts on the economic stability <br />of the area. The potential for the proposed private dining <br />areas to be used for unlawful activities may increase crime in <br />the area and reduce the viability of the business enterprise in <br />the area. <br />D. Will the proposed use comply with the regulations and conditions <br />specified in Chapter 41 for such use? <br />The proposed Appeal of the Zoning Administrator's <br />Decision will not affect the project's ability to <br />comply with all applicable conditions of Santa Ana's <br />Municipal Code Chapter 41. <br />EXHIBIT S <br />31A-25 <br />
