(3) Prior to the policy period, no insured listed under paragraph 1. of SECTION II -WHO IS AN IN- <br />SURED and no employee authorized by you to give or receive notice of an occurrence or <br />claim, knew that the "damages' had occurred, in whole or in part. If such a listed insured knew, <br />prior to the policy period, that the "damages" occurred, then any continuation, change or re- <br />sumption of such "damages" during or after the policy period will be deemed to have been <br />known prior to the policy period. <br />c. "Damages" which occurred during the policy period and were not, prior to the policy period, known <br />to have occurred by any insured listed under paragraph 1. of SECTION II - WHO IS AN INSURED <br />or any employee authorized by you to give or receive notice of an occurrence or claim, includes <br />any continuation, change or resumption of "damages" after the end of the policy period. <br />d. "Damages" will be deemed to have been known to have occurred at the earliest time when any in- <br />sured listed under paragraph 1. of SECTION II - WHO IS AN INSURED or any employee autho- <br />rized by you to give or receive notice of an occurrence or claim: <br />(1) Reports all, or any part, of the "damages" to us or any other insurer; <br />(2) Receives a written or verbal demand or claim for "damages"; or <br />(3) Becomes aware by any other means that "damages" have occurred or have begun to occur. <br />e. "Damages" because of "errors or omissions" include "damages" claimed by any person or organiza- <br />tion for care, loss of services or death resulting at anytime from the "error or omission." <br />2. Exclusions <br />This insurance does not apply to: <br />a. "Errors or omissions" for which the insured is obligated to pay "damages" by reason of the assump- <br />tion of liability in a contract or agreement. This exclusion does not apply to liability for "damages" <br />thatthe insured would have in the absence of the contract or agreement. <br />Ill Any obligation of any insured under any workers' compensation, unemployment compensation, <br />disability benefits law, Federal Securities Act of 1933, Employee Retirement Income Security Act of <br />1974 (ERISA) or under any similar law. <br />c. Injury arising out of the ownership, maintenance, use or entrustment to others of any aircraft, "auto," <br />or watercraft owned or operated by or rented or loaned to any insured. Use includes operation and <br />"loading or unloading." <br />d. Injury arising out of a dishonest, fraudulent, malicious or criminal act by any insured. <br />e. (1) Injury arising out of the actual, alleged or threatened discharge, dispersal, seepage, migration, <br />release or escape of pollutants: <br />(a) At or from any premises, site or location which is or was at any time owned or occupied by, <br />or rented or loaned to, any insured; <br />(b) At or from any premises, site or location which is or was at any time used by or for any in- <br />sured or others for the handling, storage, disposal, processing or treatment of waste; <br />(c) Which are or were at any time transported, handled, stored, treated, disposed of, or pro- <br />cessed as waste by or for any insured or any person or organization for whom you may be <br />legally responsible; or <br />(d) At or from any premises, site or location on which any insured or any contractors or <br />subcontractors working directly or indirectly on any insured's behalf aredp�jirming <br />operations: ie�e <br />�e4 tol e <br />(1) If the pollutants are brought on or to the premises, site or location i n ctio <br />such operations by such insured, contractor or subcontractor; or evas <br />G13 <br />a GLS-172s (6-14) Page 2 of 10 <br />
