PUBLIC HEARINGS <br />Commissioner Alderete arrived at 5:35 p.m. <br />1. CONDITIONAL USE PERMIT NO. 2016-36 AND VARIANCE NO. 2016-07 <br />(Applicant: James Gartner, 4414 Westminster Ave LLC — 4412 Westminster Avenue) <br />Commissioner Gartner recused himself and departed meeting. <br />Matter continued from the October 10, 2016 Planning Commission meeting to <br />October 24, 2016; and from October 24, 2016 to November 28, 2016 meeting. <br />Legal notice published in the Orange County Reporter on September 30, 2016 and <br />notices mailed September 29, 2016. <br />A project update was provided by Vince Fregoso, Principal Planner. He addressed <br />the Planning Commission concerns and described modifications made to address <br />those concerns. In addition, he requested a condition be added to require the <br />applicant provide growing vines on the south side of the wall bordering the <br />residential property. Chairperson Verino opened the public hearing. Sherry Davis <br />and James Kinney, mobile home residents, spoke in support of the project. William <br />Prescott, property owner and applicant, spoke on modifications made to the project, <br />additional noise study, the addition of sound wall and the planting of Italian cypress <br />trees on the mobile home side. Mr. Prescott answered questions and spoke in <br />support of the project. There were no additional speakers on the matter and the <br />hearing was closed. <br />AMENDED MOTION: <br />1. Adopt a resolution approving Conditional Use Permit No. 2016-36 as <br />conditioned. <br />2. Adopt a resolution approving Variance No. 2016-07(a) as conditioned to <br />allow a reduction in required setbacks. <br />3. Adopt a resolution approving Variance No. 2016-07(b) as conditioned to <br />allow the building to exceed the allowable height. <br />4.
