Below are the excerpted paragraphs from the ISO Business Auto <br />Coverage form which explains the coverage. <br />Section II Liability Coverage, <br />A. Coverage, <br />1. Who Is An Insured, <br />c. anyone liable for the conduct of an "insured" described above <br />but only to the extent of that liability <br />Section 1V Business Auto Conditions, <br />B. General Conditions, <br />5. Other Insurance <br />c. Regardless of the provisions of Paragraph a. above, this <br />Coverage Form's Liability Coverage is primary for any liability <br />assumed under an "insured contract". <br />Section V Definitions, <br />H. "Insured contract" means:, <br />5. "That part of any other contract or agreement pertaining to your <br />business (including an indemnification of a municipality in connection <br />with work performed for a municipality) under which you assume the tort <br />liability of another to pay for "bodily injury" or "property damage" to a <br />third party or organization. Tort liability means a liability that would be <br />imposed by law in the absence of any contract or agreement. <br />By California state law the Insured's Auto insurance will always be primary with respect <br />to the Insured's owned autos. <br />
