C-6-0069 <br />BETWEEN <br />ORANGE COUNTY TRANSPORTATION AUTHORITY <br />AND <br />CITY OF SANTA ANA <br />THIS AMENDMENT NO. 6 is effective as of this 15t day of March, 2016, by and between the <br />Orange County Transportation Authority, (hereinafter referred to as "AUTHORITY") and the City of <br />Santa Ana, a charter city and municipal corporation of the State of California (hereinafter referred to as <br />"CITY") <br />WITNESSETH: <br />WHEREAS, by Cooperative Agreement No. C-6-0069 dated June 12, 2006, as last changed by <br />Amendment No. 5, dated May 6, 2015, AUTHORITY and CITY entered into a cooperative agreement <br />for the Bristol Street Widening Project; and <br />WHEREAS, AUTHORITY and CITY desire to amend the Payment provision of the Cooperative <br />Agreement in order to simplify the disbursement of funding to the CITY, with no increase in the <br />AUTHORITY's maximum obligation and to clarify financial reporting responsibilities of CITY; <br />NOW, THEREFORE, it is mutually understood and agreed by AUTHORITY and CITY that <br />Cooperative Agreement No. C-6-0069 is hereby amended in the following particulars only: <br />1. Amend ARTICLE 2. SCOPE AND DEFINITIONS, pages 2 and 3 of 26, to delete <br />paragraph A. Scope of Agreement, in its entirety and, in lieu thereof, insert the following: <br />"A. Scope of Agreement — This Agreement specifies the procedures that <br />AUTHORITY and CITY will follow in implementing their respective roles and responsibilities in the <br />design, construction, right-of-way acquisition and funding of the PROJECT. Specifically, CITY will <br />conduct its responsibilities in general compliance with the State of California Guidelines Relating to Gas <br />Tax Expenditures for Cities and Counties, dated August 2015.
