shall be performed according to all zoning, open space, and public right-of-way standards to the <br />satisfaction of the Planning and Building and Public Works Agencies, <br />4.2.3 Developer shall improve the alley adjacent to the property according to <br />specifications deterinined during the entitlement review process. <br />4.2.4 Developer shall remove the existing pedestrian bridges. <br />4.3 Covenant to Operate Retail Uses on Ground Floor, The Developer hereby covenants that <br />the ground floor of the Project as described in the Scope of Development shall be used <br />exclusively for pedestrian oriented commercial uses, and no other use shall be perinitted without <br />the written consent of the City, This covenant shall be incorporated into the Grant Deed <br />conveying the City Property from the City to Developer. <br />4.4 Development Review. Within the times established in the Schedule of Performance, the <br />Developer shall submit to the City for review and approval all construction plans, drawings and <br />related documents for the construction and development work to be done on the City Property. <br />The now development project shall be designed by a highly credible design team to exemplify <br />the City's commitment to excellent design and sustainability in Santa Ana, including <br />earthquake/seismic standards. Final construction plans and drawings are defined as those in <br />sufficient detail to obtain a building permit. <br />4.4.1 The Developer shall obtain all approvals a -ad permits that may be required under <br />the City's normal plan check, development review and approval process for the construction and <br />development work to be completed on the City Property, or applicable portion thereof, and shall <br />pay all fees and costs associated with such review consistent with the City's normal entitlement <br />process. The Project, and all plans, drawings and related documents for the development of the <br />City Property, shall be consistent with the City's General Plan and Zoning Code. During the <br />preparation of any drawings and plans for the development and construction work to be <br />completed on the City Property, the Developer shall meet with City staff and communicate and <br />consult informally and as frequently as is necessary to ensure that the formal submittal of any <br />documents to the City pursuant to this Section 4.4 can receive prompt consideration. <br />4.4.2 The City shall approve or disapprove the plans, drawings and related documents <br />submitted pursuant to this Section 4.4 in accordance with City's normal plan check procedures. <br />Any disapproval shall state in writing the reasons for disapproval and the changes that the City <br />requests be made. Such reasons and such changes must be consistent with the Scope of <br />Development and any items previously approved hereunder by the City. The Developer, upon <br />receipt of a disapproval, shall revise such plans, drawings and related documents and resubmit <br />them to the City as soon as possible after receipt of the notice of disapproval, provided that in no <br />case shall the City be entitled to require changes inconsistent with the Scope of Development and <br />any previously approved items, <br />4.4.3 If the Developer desires to make any material change in the construction plans <br />after their approval by the City, the Developer shall submit the proposed change to the City for <br />its approval.
