Contractor of any such assessment and Contractor shall have <br /> ten ( 10 ) days thereafter in which to request a hearing by <br /> the City Council , which may affirm , modify, or revoke the <br /> decision of the Director of Public Works . Such damages , <br /> unless revoked by the City Council , shall thereafter be set <br /> off against moneys due or to become due the Contractor , It <br /> is agreed that in the event of a breach by the Contractor of <br /> his performance requirements under this Agreement , it would <br /> be impractical or extremely difficult to fix the actual <br /> damage and therefore the Contractor agrees that upon such a <br /> breach he will pay to the City as liquidated damages and not <br /> as a penalty the sum of one hundred dollars ( $100 . 00 ) for <br /> each day on which such breach occurs, which represents a <br /> reasonable compensation for the loss incurred because of <br /> such breach . <br /> 14 . Standards for Collection, Equipment and Noise <br /> Equipment used by the Contractor for the <br /> collection and hauling of refuse shall be used so as to <br /> assure , in the opinion of the Director of Public Works , that <br /> adequate standards of collection will be maintained . It is <br /> the declared interest of the City that the Contractor be <br /> able to provide a variety of sizes of containers to meet the <br /> capacity requirements of commercial and multiple residential <br /> users . No material shall be permitted to leak, fall or be <br /> spilled on City streets , alleys or highways. Any such <br /> leakage or spills occurring shall be immediately corrected <br /> 15 . , <br />
