business hours to allow the Auditor to review Contractor' s <br /> accounting systems, procedures, and costs. Such reviews <br /> shall be conducted by the Auditor at any time as directed by <br /> the City. The Auditor shall have access to the cost data <br /> for Contractor' s total operation as well as to the portions <br /> thereof relating to the City of Santa Ana, if the Auditor <br /> reasonably deems such information to be relevant to his <br /> duties pursuant to this contract. <br /> (c) Any report from the Auditor to the City resulting <br /> from the Auditor' s review of Contractor' s records shall be <br /> limited to a letter of compliance relating to accounting <br /> procedures and to the identification of Contractor' s costs , <br /> and shall not set forth Contractor' s actual operating results. <br /> The Auditor shall also make such recommendations as he deems <br /> necessary as to the adequacy of Contractor' s data collection <br /> methods, and as to the availability and sufficiency of the <br /> information, including direct, indirect and joint costs , <br /> with respect to any request pursuant tc> section 27 (b) by <br /> Contractor for increased compensation, and shall furnish the <br /> City with his opinion as to whether the increase is supportable <br /> by Contractor' s records. <br /> 30. Bond <br /> The Contractor shall, prior to the initial <br /> date of the term of this Contract, execute and file with the <br /> City Clerk a surety bond in the penal sum of one hundred <br /> thousand dollars ($100 , 000. 00) conditioned upon the faithful <br /> performance of this Contract by the Contractor and his <br /> subcontractors, if any. Said bond may be written for a term <br /> of one year, and may thereafter be renewed by certificate, <br /> provided however, that the Contractor agrees to maintain <br /> such bond or bonds in force for the complete term of this <br /> Contract. <br /> 31. Notices <br /> Any notice required by this Contract shall be <br /> sufficiently served if personally delivered or if deposited <br /> -25- <br />
