treated as refuse collectable under this contract <br /> (except insofar as disposed of under the provisions of <br /> section 17) . All kitchen waste, ashes, hair clippings, <br /> floor sweepings and similar light materials must be <br /> well and securely wrapped to prevent spillage and to <br /> protect the public health and safety. Hot ashes will <br /> not be collected. Contractor shall not be required <br /> to pick up and collect more than 200 lbs. (including <br /> containers) for each service unit stop except at single- <br /> family dwellings, duplexes , and triplexes. <br /> 10. Failure To Collect <br /> Should the Contractor fail to collect and/or <br /> dispose of refuse in accordance with this Contract and the <br /> collection schedules then in effect pursuant to Section 7 , <br /> the City, after written notice to the Contractor, may collect <br /> and/or dispose of all or any part of such refuse, or initiate <br /> services to cause or promote its collection and/or disposal, <br /> using City employees or independent contractors , and the <br /> Contractor shall be liable for all reasonable expenses <br /> thereby incurred by the City. The City may give such notice <br /> for any specified individual omission by Contractor, in <br /> which event Contractor shall be allowed a reasonable time, <br /> not to exceed the close of the following workday to remedy <br /> such omission. In the event of substantial nonperformance <br /> by Contractor, for any reason, including a strike of Con- <br /> tractor' s employees, the notice shall continue in effect <br /> with respect to refuse originating thereafter as long as the <br /> omission continues. In addition to any other lawful means <br /> of effecting reimbursement from the Contractor, such expenses <br /> may be deducted by the City from money due or which may <br /> become due the Contractor. In addition, Contractor shall <br /> allow City the use, without charge, of any of Contractor' s <br /> collection vehicles, containers, and other equipment not <br /> then in actual use by Contractor which City shall deem <br /> necessary to provide collection and/or disposal services <br /> -8- <br />
