The Contractor shall also be bound by and comply with the provisions • <br /> of Sections 1850 to 1854, inclusive, of the Labor Code of the State of <br /> California. <br /> (j ) Use by City of Contractor ' s Equipment <br /> Upon the termination of the contract for any reason prior to the <br /> end of the period specified herein as the term of- the contract, the <br /> city shall have the exclusive right to rent or lease and operate any <br /> or all trucks trailers, , tractors, bulldozers and other items of <br /> equipment used by the Contractor in the performance of the work <br /> specified in these specifications. <br /> The right of the City to enter upon, use, rent, or lease facilities <br /> and equipment as specified herein shall extend from the date of <br /> termination of the contract for a period of sixty (60) calendar days. <br /> The rental prices to be paid by the City to the Contractor under the <br /> provisions of this sub-section shall be as follows: <br /> Garbage or refuse trucks-Thirty-five Dollars ($35.00) per <br /> Calendar day; Containers (1 yard or larger)-One Dollar <br /> ($1.00) per calendar day. <br /> Any moneys due the Contractor for rental of equipment under the <br /> provisions of this sub-Section may be withheld by the City and used <br /> by it for the purpose of paying any outstanding liens or payments <br /> due and unpaid upon the said equipment. <br /> • <br /> SECTION 4. PAYMENTS BY CITY <br /> (a) Basic Computation <br /> As compensation for the performance by the Contractor of the work <br /> described in this contract he shall receive from the City, on or before <br /> the tenth day of each calendar month, the amount stated in the contract <br /> multiplied by the total number of active water meters listed in the <br /> City Water Department on the last day of the preceding calendar month, <br /> and, in addition, the number of units served by water producers other <br /> than Santa Ana city operated facilities. This number has been determined <br /> as 3,422 as of June 1, 1963. Increases or decreases will be reported <br /> by the Director of Public Works to the Director of Finance on the last <br /> day of each month. The records of said Water Department shall be <br /> available upon reasonable demand by the Contractor for the purpose of <br /> auditing the number of said meters. <br /> .(b) Compensation Readjustment <br /> On the first day of each November and May of each succeeding year <br /> the contract unit price shall be adjusted to reflect the percentage <br /> change in the Consumers ' Price Index (1957-59 base) Los Angeles Area, <br /> published by the U.S.Department of Labor, as indicated by the index <br /> figure most recently published prior to the first day of June and <br /> January preceding each of the above listed dates respectively. The <br /> adjustment shall be computed by using the figure of 108.0 as equal <br /> to 100 and increases or decreases in the contract unit price shall be <br /> 1 per unit for each increase or decrease of one full percentage point <br /> from the base of 108.0. <br /> Page 9, of 12 <br />
