CITY' S expense in the absence of CONTRACTOR' S performance , <br /> CONTRACTOR shall be liable to CITY for a proportionate amount of <br /> the customers ' payments due to the CONTRACTOR. <br /> 26 . Term of Contract: <br /> A. The term of this Contract shall begin on January 1 , <br /> 1987 , at which time the previously existing contract between the <br /> parties hereto shall be of no further force and effect as to any <br /> rights or obligations which have accrued to either party pursuant <br /> to said previous contract prior to such date . The term of this <br /> Agreement shall extend to June 30 , 1993 ; and thereafter to June 30 <br /> of such subsequent year as the parties may mutually agree upon. <br /> B . In 1992 , and in any other calendar year preceding <br /> a year in which any renewal of this Agreement terminates , the <br /> parties shall meet and confer during the period July 1 through <br /> December 31 of each calendar year, concerning renewal, with or <br /> without amendment , of this Agreement. In the event that the <br /> parties fail to reach agreement on renewal of this Agreement <br /> during such period , this Agreement shall terminate June 30 of <br /> the following calendar year. <br /> No increase in the compensation due CONTRACTOR other <br /> than under sections 21 and 22 shall be made unless CONTRACTOR <br /> demonstrates to the satisfaction of the Auditor that CONTRACTOR <br /> has become subject to substantial cost increases for reasons <br /> beyond CONTRACTOR' S control to the point that it is no longer <br /> profitable for CONTRACTOR to continue in business without a <br /> compensation increase. In such event , the increase in compensa- <br /> tion shall not exceed an amount necessary to allow CONTRACTOR <br /> 30 . <br />
