<br /> That we , GREAT WESTERN RECLABATIOd INCORPORATED, as Principal ,
<br /> and FIREMAN' S FUND INSURANCE COMPANY, as Surety, are held and
<br /> firmly bound unto the CITY OF SANTA ANA, CALIFORNIA, as Obligee ,
<br /> in the sum of ONE HUNDRED THOUSAND AND NO/100 - - - - Dollars
<br /> ($100 , 000. 00) , for the payment of which sum, well and truly to
<br /> be made , we bind ourselves , our successors and assigns , jointly
<br /> and severally, firmly by these presents .
<br /> THE CONDITION OF THIS OBLIGATION IS SUCH THAT :
<br /> WHEREAS, said Principal has entered into an Agreement dated
<br /> August 12 , 1963 and an amended Agreement on March 24 , 1969 , with
<br /> the City of Santa Ana for refuse collection services and is re-
<br /> quired by said City of Santa Ana to give this bond in connection
<br /> with the execution of said Contract Agreement.
<br /> NOW, THEREFORE , if the said Principal shall , beginning with the
<br /> 1st day - of November , 1970 , faithfully perform all the conditions
<br /> of said Agreement , then this obligation shall be null and void;
<br /> otherwise to remain in full force and effect for the period
<br /> thereof;
<br /> Provided, further , that, the term of this bond shall be for the
<br /> period of one year commencing November 1 , 1970 and ending
<br /> Octobo_ 31 , 1071 and m y ba, at the Surety` sv-=tion, renewed
<br /> _-orJsubsequent periods of time by the issuance a Continuation
<br /> Certificate. However , this bond may not be declared in default
<br /> or recovered thereon solely by the failure of the Surety to issue
<br /> such Continuation Certificate or by the failure of the Principal
<br /> to provide a new corporate surety bond for subsequent periods of
<br /> time , provided however that such failure to renew by Certificate
<br /> or otherwise shall not affect or impair any right of recovery upon
<br /> this obligation for reimbursement for damage or expense incurred
<br /> by reason of any violation which occurred, prior to the effective
<br /> date of such refusal to renew.
<br /> Notices in connection herewith shall be delivered to the Surety
<br /> 1
<br /> at its Branch Office in Santa Ana , California, 1950 East 17th
<br /> I Street, Santa Ana , California , 92702 .
