y <br /> • <br /> RESOLUTION NO. 75- 25 <br /> A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ' <br /> SANTA ANA ESTABLISHING REVISED SCHEDULE OF RATES <br /> FOR REFUSE COLLECTION AND. RESCINDING RESOLUTION 74-143 ' <br /> WHEREAS, Article II, Chapter 16 of the Santa Ana Municipal <br /> • Code provides for refuse collection regulation and authorizes the <br /> establishment of charges for the collection and disposal of refuse <br /> ' by resolution; and <br /> • <br /> • WHEREAS, Resolution 74-143 established rates for collection and <br /> r disposal of refuse "including rates for commercial containers which <br /> have been in effect since September 1971; and <br /> WHEREAS, increased costs since 1971 now require an upward <br /> adjustment in commercial container charges; <br /> • <br /> NOW, THEREFORE, BE IT RESOLVED: That Resolution 74-143 is <br /> rescinded. ' <br /> BE IT FURTHER RESOLVED: That the rates hereinbelow set out <br /> are the rates that shall be due to the City for the collection <br /> and disposal of refuse and/or for standby or the availability of <br /> said service. Said rates shall be added to the rate charges for <br /> water service and billed with the bill for water service. Any <br /> residential, commercial, or industrial occupancy not served by . <br /> • Santa Ana water service, and any residential, commercial, or <br /> industrial occupant of an identifiably separate space, but not served • <br /> by a separate water meter, shall be separately billed for standby <br /> collection and refuse disposal service. All rates for such services <br /> shall be due and payable at the Finance Department in the City Hall <br /> on the date of billing therefor and become delinquent 15 days from <br /> and after the date of such billing. .A penalty of 10% shall be charged on <br /> all unpaid bills for such service 30 days from and after the billing date. <br /> BE IT FURTHER RESOLVED: That the rates to be charged for stand- • <br /> by collection and refuse disposal service are hereby established in <br /> accordance with the schedule hereinafter set out: - <br /> Schedule of Rates for Refuse Collection and Standby Service <br /> 1. The basic rate for each single family residence for each-two <br /> months, or part thereof, shall be $3.60. <br /> • 2. The basic rate for each duplex family residence for each two <br /> months, or part thereof, shall be $5.90. <br /> 3. The basic rate for all triplex family residences for each two <br /> • <br /> months, "or part thereof, shall be $8.20. <br /> 4. a. It shall be mandatory that apartment buildings with four or <br />• <br /> more dwelling units be served by commercial container rental. <br /> The requirement for mandatory container rental may be waived <br /> for apartment buildings existing on January 1, 1972, upon <br /> • a finding by the Director of Public Works that no space is <br /> available for such container within the boundary lines of the <br /> Subject property. In no case_, however, shall container <br /> locations be permitted in the front yard set-back or within ' <br /> areas required for meeting the minimum off-street parking • <br /> requirements of applicable zoning regulations. Any applicant . <br /> who has been denied a waiver by the Director of Public Works <br /> • may appeal such action to the City'Council by filing within 30 <br /> days after such denial, a written statement of his reasons <br /> why the City Council should reverse the action from which the <br /> appeal is taken. <br />
