6. HOLIDAYS: <br /> Where, on a given route, the day of collection would be a <br /> legal holiday, CONTRACTOR shall collect along said route on the <br /> work day next following said legal holiday. Legal holidays for the . <br /> purpose of this Agreement shall be New Years Day, Memorial Day, <br /> Independence Day, Labor Day, Thanksgiving Day, Christmas Day and <br /> such other days as may be mutually agreed upon in advance by the <br /> parties. <br /> 7. FREQUENCY OF COLLECTIONS: <br /> The Contractor will collect all solid waste from all areas of <br /> the CITY at least once each week and in addition will provide more <br /> frequent service for those customers using the bin or roll-off <br /> services supplied by CONTRACTOR if requested by a customer or if <br /> required by the CITY. <br /> S. MAINTENANCE OF SCHEDULES: <br /> Presently existing routes, schedules and times for collection <br /> of solid waste shall be maintained but may . be changed by <br /> authorization of the Executive Director and at least one week's <br /> advance notification by CONTRACTOR to occupants of the buildings in. <br /> the area where the changes are to be made. <br /> 9. EXCLUSIVENESS OF AGREEMENT: <br /> The CONTRACTOR shall have the exclusive duty, right and <br /> privilege to collect, transport, process, recycle, divert by means <br /> of composting, mulching, and/or transforming, retain and dispose of <br /> all solid waste, as defined in this Agreement, generated and/or <br /> accumulated within the CITY, except as provided below. CONTRACTOR <br /> recognizes that this grant of exclusiveness is subject to the <br /> restraints provided in Public Resources Code Sections 49520 et seq. <br /> (a) The grant of exclusiveness shall not include construction <br /> and demolition solid waste which has accumulated and/or been <br /> generated at a temporary construction site and which is being <br /> disposed of in a roll-off container(s) . <br /> (b) This Agreement shall not prohibit the persons who generate <br /> solid waste, or the persons who own the premises upon which solid <br /> waste has been generated or accumulated, from personally collecting, <br /> transporting and disposing of their own solid waste so long as they <br /> dispose of such solid waste at a site permitted by the California <br /> Integrated Waste.Management Board in accordance with all governing <br /> laws and. regulations. <br /> (c) This Agreement shall not prohibit the persons who generate <br /> solid waste, or the persons 'who own the premises upon which solid <br /> waste has generated or accumulated, from: (1) selling their <br /> recyclable solid wastes, or, (2) donating their recyclable solid <br /> 7 <br />
