remove the graffiti within the required two (2) business days for <br /> bins and five (5) business days for roll-off containers, excluding <br /> holidays, shall result in the assessment of a two hundred dollar <br /> ($200. 00) fine to the CONTRACTOR. CONTRACTOR may charge the user <br /> of a bin or roll-off container which requires such graffiti removal <br /> a charge of twenty five ($25. 00) dollars per incident. <br /> (d) The Solid Waste collection and Recycling plastic carts <br /> receiving curbside service shall be replaced where found by <br /> CONTRACTOR. The CITY reserves the right, upon submission of proof <br /> by the Curbside Service Unit, to withhold sufficient compensation <br /> under this Agreement to adjust and pay any claim for Solid Waste <br /> collection and Recycling plastic carts damaged by the willful or <br /> careless acts of the employees of the CONTRACTOR. Repairs and <br /> replacement costs for said plastic carts shall be borne by <br /> CONTRACTOR; provided, however, that such repairs and/or <br /> replacements costs shall not be borne by CONTRACTOR when caused by <br /> the wanton or intentional destruction thereof by the Curbside <br /> Service Unit. Curbside Service Units shall be billed by CONTRACTOR <br /> for replacements caused by intentional or wanton destruction. <br /> 21. COLLECTION OF BULKY ITEMS: <br /> In order to promote public sanitation and reduce fire hazards, <br /> CONTRACTOR shall provide to all Curbside Service Units the service <br /> of curbside collection of bulky items such as couches, <br /> refrigerators, rugs, water heaters, and other items of Solid Waste, <br /> which CONTRACTOR is not required to collect under Section 12 <br /> because of size or weight, as follows: <br /> (a) Upon request by a Curbside Service Unit within the CITY, <br /> CONTRACTOR shall provide no more than two at-demand bulky item <br /> collections per year per Curbside Service Unit at no additional <br /> cost. Each such Curbside Service Unit is limited to a maximum of <br /> four (4) bulky items per pick-up request. Such collection services <br /> shall provide the opportunity of having large objects, and other <br /> Solid Waste which is not required to be picked up pursuant to this <br /> Agreement, picked up and processed properly. Requests by Curbside <br /> Service Units for such collections shall be made directly to the <br /> CONTRACTOR who shall provide satisfactory telephone message <br /> receiving, transmitting and response procedures and who shall be <br /> responsible for maintaining a log of such large item collections. <br /> At demand pick ups shall be responded to by CONTRACTOR within a <br /> reasonable time but no more than five (5) working days after such <br /> a request is received. Requests for more than two (2) at-demand <br /> collections per year shall cost thirty ($30. 00) dollars per <br /> collection and shall be billed to the Curbside Service Unit <br /> requesting the additional collection by the CONTRACTOR. <br /> (b) CONTRACTOR shall provide assistance of removal of bulky <br /> items on private property to senior citizens and the disabled at no <br /> cost. <br /> 20 <br />
