(b) Rates for Commercial/Industrial Bin Service, including <br /> Gate Fees, Hauling Charges, Processing Charges and any Recycling <br /> and Yard Waste Diversion, shall be as set forth on Exhibit "C" <br /> attached hereto and incorporated by reference herein. Such rates <br /> shall include a one (1%) percent charge based on Gross Receipts <br /> which shall be paid to the CITY by CONTRACTOR on a monthly basis <br /> and which shall be due and payable on or before the last calendar <br /> day of each month for the previous month. Said charge shall be <br /> used to offset a rate reduction approved by the CITY for senior <br /> citizen and mobile home park Curbside Service Units. CONTRACTOR <br /> shall make records containing Commercial/Industrial Bin Service <br /> available to the Executive Director at any reasonable time. <br /> 25. ROLL-OFF SERVICE RATES: <br /> (a) The CONTRACTOR shall receive compensation for supplying <br /> Roll-Off Service by direct billing of the Customers receiving such <br /> service by means of separate agreements entered into between the <br /> CONTRACTOR and each such Customer. A copy of every such agreement <br /> shall be made available to the Executive Director by CONTRACTOR. <br /> Roll-off Service shall be provided at a minimum of three (3) dumps <br /> per month per Customer. <br /> (b) Rates for Roll-Off Services, including container <br /> delivery, collection, hauling and transportation, shall be as set <br /> forth on Exhibit "C" attached hereto and incorporated herein by <br /> reference. <br /> 26. COMPENSATION FOR GRANTS: <br /> CONTRACTOR shall be permitted to obtain compensation in an <br /> amount approved by the Executive Director for the management of <br /> grants pursuant to Section 18 (g) herein. <br /> 27. ADJUSTMENTS TO CHARGES: <br /> (a) HAULING AND PROCESSING CHARGES: <br /> (1) CONSUMER PRICE INDEX: The two indices which will be <br /> used for determining adjustments to Hauling and Processing Charges <br /> shall be the December Consumer Price Index ("CPI") for All Urban <br /> Consumers (base years 1982-1984 = 100) for Los Angeles-Anaheim- <br /> Riverside CMSA, published by the United States Department of Labor, <br /> Bureau of Labor Statistics which will be weighted at ninety (90%) <br /> percent and the December Producer Price Index, Diesel Fuel #2 <br /> (#057303) which will be weighted at ten (10%) percent. <br /> (2) CURBSIDE SERVICE: The Hauling Charges and <br /> Processing Charges for curbside service shall be adjusted annually, <br /> if at all, beginning on July 1, 1997 . At such time the Hauling <br /> and Processing Charges shall only be adjusted if the CPI determined <br /> pursuant to subsection (a) (1) above exceeds four (4%) percent. <br /> Should the CPI be determined to be between four (4%) and seven (7%) <br /> 22 <br />
