will be responsible to subcontract for the use of such a facility <br /> so as to ensure the CITY' S compliance with CIWMA. <br /> (1) Commencing on July 1, 1993, CONTRACTOR shall be <br /> required to process at a MRF for purposes of recycling at least one <br /> third (1/3) of all solid waste collected by CONTRACTOR from <br /> curbside service units, bins and roll-off containers within the <br /> CITY; <br /> (2) Commencing on January 1, 1994, CONTRACTOR shall be <br /> required to process at a MRF for purposes of recycling two thirds <br /> (2/3) of all solid waste collected by CONTRACTOR from curbside <br /> service units, bins and roll-off containers within the CITY; and, <br /> (3) Commencing on July 1, 1994 for the duration of this <br /> Agreement, CONTRACTOR shall be required to process at a MRF for the <br /> purpose of recycling all solid waste collected by it from curbside <br /> service units, bins and roll-off containers within the CITY. <br /> (b) YARD WASTE DIVERSION: CONTRACTOR shall cause any and all <br /> segregated yard waste collected by CONTRACTOR within the CITY'S <br /> boundaries which is capable of being composted, mulched and/or <br /> transformed to be processed at a state permitted composting <br /> facility pursuant to the schedules contained in subsections (1) , <br /> (2) and (3) below. CONTRACTOR shall be responsible to ensure that <br /> the yard waste collected by CONTRACTOR is diverted in compliance <br /> with CIWMA and the CITY' S SRRE. <br /> (1) Commencing on July 1, 1993, CONTRACTOR shall be <br /> required to process at a MRF for purposes of yard waste diversion <br /> all segregated yard waste which is capable of being composted, <br /> mulched and/or transformed and which is collected by CONTRACTOR <br /> pursuant to section 13 (a) (1) above; <br /> (2) Commencing on January 1, 1994 , CONTRACTOR shall be <br /> required to process at a MRF for purposes of yard waste diversion <br /> all segregated yard waste which is capable of being composted, <br /> mulched and/or transformed and which is collected by CONTRACTOR <br /> pursuant to section 13 (a) (2) above; <br /> (3) Commencing on July 1, 1994 , for the duration of this <br /> Agreement, CONTRACTOR shall be required to process at a MRF for the <br /> purpose of yard waste diversion all segregated yard waste which is <br /> capable of being composted, mulched and/or transformed and which is <br /> collected by CONTRACTOR pursuant to section 13 (a) (3) above. <br /> (c) DISPOSAL: CONTRACTOR shall be required to dispose of any <br /> and all solid wastewhich is not recycled or diverted by means of <br /> composting, mulching and/or transforming pursuant to the terms of <br /> this Agreement, at a legally authorized disposal site(s) as <br /> designated by the CITY. If CONTRACTOR is directed to dispose of <br /> said solid waste at a location other than the County of Orange's <br /> disposal site, both parties agree to meet and confer regarding any <br /> potential rate adjustments which may be necessitated thereby. <br /> 12 <br />
