Recycling Element. <br /> (40) . Yard Waste means any wastes generated from the <br /> maintenance or alteration of public, commercial or residential <br /> landscapes including, but not limited to, leaves, yard clippings, <br /> tree trimming, brush, weeds and prunings. <br /> (41) Yard Waste Diversion shall mean the diversion from the <br /> waste stream of yard waste or organic waste and the composting, <br /> mulching, and/or transformation thereof. <br /> 4 . SCOPE OF SERVICE: <br /> (a) CONTRACTOR shall furnish all labor, material, facilities <br /> and equipment necessary for the collection of all solid waste <br /> originating, generated and/or accumulated by any person within CITY <br /> boundaries, as they now exist or may hereafter exist, and shall <br /> transport, process, recycle, divert by means of composting, <br /> mulching and/or transforming and/or dispose of said solid waste in <br /> compliance with the terms of this Agreement. <br /> (b) All solid waste collected by CONTRACTOR within the CITY <br /> shall not be commingled in the CONTRACTOR'S vehicles or equipment <br /> with solid waste from any other jurisdiction or person from outside <br /> the CITY limits; however, in the event of an emergency vehicle <br /> breakdown, a vehicle from a neighboring jurisdiction may complete <br /> the route of the vehicle which broke down. In this case, the <br /> CONTRACTOR must notify the CITY in writing within twenty four (24) <br /> hours of such emergency breakdown and must also provide the CITY <br /> with the allocation of tonnages contained in the vehicle. <br /> 5. COLLECTION HOURS: <br /> (a) All collections from residential areas shall be made <br /> between the hours of 6: 00 A.M. and 6: 00 P.M. Collections from <br /> commercial and industrial locations greater than 100 feet from <br /> residential units may start at 3: 00 a.m. and must terminate by 6: 00 <br /> P.M. ; however, if complaints are received from such residential <br /> units, the Executive Director may direct that collections in such <br /> areas shall be made between the hours of 6:00 a.m. and 6: 00 p.m. <br /> and in that event CONTRACTOR agrees to comply with such order. <br /> (b) Notwithstanding section (a) above, solid waste collected <br /> pursuant to Section 12 hereof shall be collected pursuant to the <br /> provisions contained therein. <br /> 6. HOLIDAYS: <br /> Where, on a given route, the day of collection would be a <br /> legal holiday, CONTRACTOR shall collect along said route on the <br /> work day next following said legal holiday. Legal holidays for the <br /> purpose of this Agreement shall be New Years Day, Memorial Day, <br /> Independence Day, Labor Day, Thanksgiving Day, Christmas Day and <br /> 6 <br />
