B. The following is in respect to WMNA: <br /> 1. Rainbow Disposal Co., Inc., v. Great Western Reclamation. Inc., Waste <br /> Management of North America. Inc., et.al., No. 60-9630 (Orange County, <br /> CA) <br /> In July, 1990, a competitor filed this case alleging interference with contract <br /> and predatory pricing. The case lacked any merit whatsoever and was <br /> dismissed. <br /> 2. Cumberland Farms, Inc. v. Browning-Ferris Industries. Inc., Waste <br /> Management of North America. Inc., et.al., No. 87-3717 (E.D. PA) and 10 <br /> related cases. <br /> These related civil class action lawsuits were consolidated in Philadelphia <br /> and allege an antitrust violation between 1978-1987. After years of litigation, <br /> plaintiffs acknowledged doubt as to whether the alleged violation had <br /> occurred and the parties agreed to a settlement. WMNA's settlement, <br /> totalling $19.5 million, will be distributed to customers in ten markets around <br /> the United States. <br /> 3. Acme Corporation v. Althin CD Medical. Inc.. et.al., No. C91 4268 SBA, U.S. <br /> District Court/Northern District of CA <br /> WMNA was named, along with several other parties, including <br /> approximately 18 municipalities, by a landfill owner/operator (Acme) seeking <br /> to recover response costs under CERCLA 42 U.S.C. Section 9601 et seq. <br /> WMNA was included in the suit because a subsidiary company hauled <br /> municipal solid wastes to the landfill. WMNA has since been dismissed <br /> from the suit. <br /> 4 <br />
