REQUEST FOR <br />COUNCIL ACTION <br />CITY COUNCIL MEETING DATE: <br />MARCH 7, 2017 <br />TITLE; <br />EXTENSION OF CONDITIONAL USE <br />PERMIT NO. 2015 -01 AND VARIANCE NOS. <br />2015 -01 AND 2015 -02 FOR A NEW FULL - <br />SERVICE CAR WASH TO BE LOCATED AT <br />2402 SOUTH BRISTOL STREET <br />{STRATEGIC PLAN NO. 3,2) <br />CITY NAGER <br />RECOMMENDED ACTION <br />CLERK OF COUNCIL USE ONLY: <br />❑ As Recommended <br />❑ As Amended <br />❑ Ordinance on 18' Reading <br />❑ Ordinance on 2nd Reading <br />❑ Implementing Resolution <br />❑ Set Public Hearing For <br />CONTINUED TO <br />FILE NUMBER <br />Adopt a resolution approving the extension of Conditional Use Permit No. 2015 -01 and Variance <br />Nos. 2015 -01 and 2015 -02. <br />DISCUSSION <br />In April 2015, the City Council affirmed the Planning Commission's decision to approve Conditional <br />Use Permit (CUP) No. 2015 -01 and Variance Nos. 2015 -01 and 2015 -02 for the South Coast <br />Speedwash development at 2402 South Bristol Street. The conditional use permit allowed the use <br />of the property for a car wash facility, and the variances were to allow a reduction in required <br />setbacks and parking. Due to the complexities of the project and the challenges of securing <br />services required to engineer the mixed -use project site, which includes a car wash, administration <br />building, and a multi- tenant commercial building, the applicant was unable to move forward with <br />construction before the entitlements expired. The applicant is currently in the Building plan check <br />process but will be unable to begin construction before entitlements expire. <br />Pursuant to Section 41 -647 of the Santa Ana Municipal Code (SAMC), CUPS, variances, and other <br />entitlements automatically become void should the property owner fail to institute an action to <br />comply with the provisions of the entitlements within two years of its approval. This section of the <br />code also allows the property owner to request an extension of the entitlement up to a period of <br />three years from the date of expiration. Although construction has yet to begin, the applicant <br />would like to maintain the entitlements for the CUP and variances and is requesting a one -year <br />extension of the approvals. The applicant has secured the expertise of a well- experienced <br />architectural team and submitted plans into plan check in December 2016. Since the applicant is <br />planning to move forward with the project, the Planning Division recommends that the entitlements <br />for the mixed -use car wash development be extended by a period of one year from the date of City <br />Council approval. <br />55A -1 <br />
