COOPERATIVE AGREEMENT NO. C -5 -3583 <br />1 "Mitigation Monitoring and Reportinq Program" means the program for the implementation of <br />2 the mitigation measures adopted forthe Project as identified by the CITY in the Revised Environmental <br />3 Assessment (REA) /Final Environmental Impact Report (FEIR) approved by the CITY'S City Council <br />4 on January 20, 2015. <br />5 "OC Streetcar" is the operating streetcar vehicles and all streetcar infrastructure including the <br />6 track, the overhead contact system (wires, poles, conduits, and appurtenances), the traction power <br />7 system (substations, conduits, controllers, and appurtenances), streetcar signage, stations or stops <br />8 (lighting, shelters, and all stop features), utilities supporting the streetcar from point of service, and a <br />9 maintenance and storage facility (MSF). <br />10 "Operations and Maintenance Agreement" means the cooperative agreement between the <br />11 AUTHORITY and the CITY establishing the roles, responsibilities, and expectations with respect to <br />12 the operations and maintenance of the OC Streetcar. <br />13 "PE ROW" means the property owned by the AUTHORITY, previously the Pacific Electric <br />14 Railroad ROW, intended to be used for the -OC Streetcar between Raitt Street_ and Harbor Boulevard. <br />15 "Plans and Specifications" means the Project plans, specifications, and special provisions <br />16 prepared by the Design Consultant and /or the AUTHORITY providing the information necessary to <br />17 construct the Project. <br />18 " Proiect Submittals" means all design drawings, product data, test data, specifications, design <br />19 submittals, schedules, cost estimates, erection drawings or similar documents which are produced by <br />20 or on behalf of the AUTHORITY during the design of the Project, and which relate to the Plans and <br />21 Specifications or otherwise affect the interests of the CITY under this Agreement. <br />22 "Public Way Use Agreement" means the agreement established between the Parties <br />23 establishing the AUTHORITY's right to use the CITY's public way for the OC Streetcar. <br />24 "Ready to Bid" is a design package level of completeness indicating the design is complete, <br />25 the CITY's comments have been addressed, all drawings and specifications have been affixed with a <br />26 seal as required, and the title sheet has been signed by both the AUTHORITY and the CITY. <br />Page 4 of 13 <br />L: \Camm\ CLERICAL \WORDPROC\AGREE\AG53583 -25E z &.04.27.docx <br />
