C-6-1516 <br />EXHIBIT B <br />accept, shall be further discussed and resolved in accordance with this Agreement and if not <br />resolved in a timely manner shall be resolved using the Dispute Resolution process in Article <br />11 L of this Agreement; and <br />E. The construction phasing of the City Bike Lane Project shall be coordinated with the <br />construction of the Project hardscape elements such as curbs, trackway, platforms, <br />pavements, and ramps. Prior to initiating construction of the City Bike Lane Project, the CITY <br />shall coordinate with the AUTHORITY to ensure the timing of the City Bike Lane Project <br />construction will not negatively affect Project construction. <br />5.2 OTHER CITY PROJECTS <br />If the CITY implements any capital projects within the Project construction limits, notification <br />shall be sent to the AUTHORITY identifying the location of the project and timing of the <br />implementation. The CITY and AUTHORITY agree to coordinate construction activities recognizing, <br />the OC Streetcar Project cannot be negatively impacted by the initiation of an adjacent project. <br />The AUTHORITY will make its Construction Contractor aware of other CITY projects that may <br />impact or may have impacts on Project construction to the extent notified by the CITY of such <br />projects. The AUTHORITY shall provide in its contract with the Construction Contractor that to the <br />extent reasonably feasible the Construction Contractor will coordinate its activities with contractors <br />working on CITY projects and will not interfere with such work or cause damage thereto; provided that <br />such coordination and/or non-interference does not result in any change orders, delay Project <br />construction, or create safety concerns. <br />For any capital projects within the construction limits of the Project that commence after the <br />award of the Project, the CITY shall include language that requires its contractors to coordinate their <br />activities with the Project construction and to perform such work in a manner which does not interfere <br />with Project construction or cause any damage to such Project construction. <br />Exhibit B <br />Page 8 <br />
