C-6-1516 <br />"Day" or "Days" means calendar days unless a different meaning clearly appears from the <br />I context. <br />"Design Agreement" means Cooperative Agreement No. C-5-3583 between AUTHORITY and <br />CITY for the design phase of the OC Streetcar Project, dated May 9, 2016, which sets forth the terms <br />and conditions to which the OC Streetcar Project will be designed. <br />"Design Consultant" means the firm(s) procured by the AUTHORITY to perform preliminary <br />and/or final design services to produce the Plans and Specifications. <br />"Effective Date" means the date this Agreement is executed by the Parties. <br />"FEIR" means the Revised Environmental Assessment (REA)/Final Environmental Impact <br />Report certified by the CITY's City Council on January 20, 2015. <br />"Mitigation Monitoring and Reporting_ Program" means the program for the implementation of, <br />the mitigation measures adopted for the Project in the Revised Environmental Assessment <br />(REA)/Final Environmental Impact Report (FEIR) approved by the CITY's City Council on January 20, <br />2015. <br />"OC Streetcar System" means the OC Streetcar passenger transportation system to be owned, <br />operated, and maintained by the AUTHORITY, including all tracks, stations, streetcar vehicles, <br />conduits, electrical lines, traction power poles, traction power substations, cross -span wires, streetcar <br />signal equipment, maintenance facilities and other functionally related and appurtenant equipment <br />and facilities. <br />"Operations and Maintenance Agreement" means the cooperative agreement between the <br />AUTHORITY and the CITY establishing the roles and responsibilities with respect to the operations <br />and maintenance of the OC Streetcar. <br />"PE ROW" means the property owned by the AUTHORITY intended to be used for the OC <br />Streetcar between Raitt Street and Harbor Boulevard. <br />1 <br />1 <br />l:lcammlclericallvvordproclagreelag61516.docx <br />Page 4 of 15 <br />
